1. The Information We Collect

During the course of your interaction with us, we may collect the following information:

•     If you are a Website visitor: your IP address, browser and device type, pages visited, and cookies.

•    If you are a prospective client submitting an inquiry: your name, email, phone number, address, organization, the nature of your legal matter, and any documents you choose to share with us.

•  If you are a current or former client: the above, together with billing and financial details, case-related documents and communications, and government-issued identification where relevant to your matter.

• If you are a newsletter subscriber: your name and email address.

• If you are a job applicant: your resume/CV, cover letter, and educational and employment history.

We do not collect government identification as a matter of routine. Where identification such as a PAN card, passport, driving licence, or Aadhaar is required for a specific matter, we will request only what is necessary and inform you why it is needed. Aadhaar is never collected as a default requirement.

Where you engage us, we may also receive sensitive information in the course of your matter, including details of disputes, litigation, financial affairs, or personal circumstances relevant to your case. Such information is protected by attorney-client privilege and professional confidentiality, in addition to the safeguards described in this Policy, and is used solely for the purpose of your representation.

Our website is not directed at individuals under the age of 18. Where a matter involves a minor, related personal data is collected and processed only with the verifiable consent of a parent or lawful guardian.

2. How We Use Your Information

We use your information to respond to your inquiries, provide legal advice and representation, conduct conflict checks and formalize client engagements, communicate with you on billing and case matters, maintain records required under Bar Council of India rules and applicable law, operate and secure the Website, send newsletters or updates where you have subscribed, and evaluate job applications. We do not use your information for any purpose beyond what is stated here, or beyond the scope of your engagement, without your consent.

3. Disclosure of Information

We do not sell, rent, or trade your personal data. We may share your information with Firm personnel who need it to act on your matter or inquiry, with service providers who support our operations under confidentiality obligations equivalent to our own, with co-counsel or expert witnesses engaged in connection with your matter, where required by law or pursuant to a court order or regulatory request, or with your consent, to any other named third party. As Tuskh Law advises clients located outside India, personal data may in some cases be transferred outside India in connection with your matter. Such transfers are made in accordance with the Digital Personal Data Protection Act, 2023, which permits cross-border transfer of personal data except to countries specifically restricted by the Central Government from time to time. We take reasonable contractual and organizational steps to ensure that data transferred in this manner continues to receive an appropriate standard of protection.

4. Security

We adopt reasonable technical and organizational security practices appropriate to the sensitivity of the information we hold. Access to your information is restricted to Firm personnel on a need-to-know basis for each matter, and all lawyers and staff are bound by confidentiality obligations consistent with our professional conduct rules. We maintain a defined internal process for responding to any suspected security incident, including notification to affected individuals and the Data Protection Board of India where required by law. No system can be guaranteed completely secure, and we encourage you to exercise care when sharing sensitive information with us electronically, particularly before a formal engagement has been confirmed.

5. Data Retention

We retain your information only as long as necessary for the purposes described in this Policy. Client and matter-related records are retained for six years from the closure of the matter, or longer where required by applicable law or an ongoing legal obligation. Inquiries that do not result in an engagement are retained for a reasonable period to allow follow-up or deleted earlier on request. Newsletter data is retained until you unsubscribe, and job applicant data is retained for the recruitment process and a reasonable period thereafter, unless you request earlier deletion.

6. Your Rights

As a Data Principal under the Digital Personal Data Protection Act, 2023, you have the right to access a summary of the personal data we hold about you, correct or update inaccurate data, request erasure of data no longer needed for the purpose collected, withdraw consent at any time, raise a grievance with our Grievance Officer and escalate it to the Data Protection Board of India if unresolved, and nominate another individual to exercise these rights on your behalf in the event of your death or incapacity.
